These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and the operator of Narcis.ai ("Narcis", "we", "us", "our"), governing your use of the Narcis.ai platform and services accessible at https://narcis.ai (the "Service").
By accessing or using the Service, you agree to be bound by these Terms, our Acceptable Use Policy, and our Privacy Policy. If you do not agree, you must not use the Service.
Narcis.ai uses artificial intelligence to generate portraits and perform face swaps from user-provided inputs. The Service offers two modes:
Narcis.ai is not the producer of User-Generated Content. Our role is limited to hosting the AI model, providing the interface, and processing the generation. The User who initiates a generation is solely responsible for the inputs they provide and the use they make of the output.
All AI-Generated Content is synthetic. No images produced by the Service depict actual events or real scenes.
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement. We reserve the right to request proof of age and to terminate accounts where we have reason to believe a User is under 18.
5.1 Account Creation. Certain features require account registration. You must provide accurate information and maintain its accuracy. You are responsible for all activity under your account.
5.2 Tokens. The Service operates on a token-based system. Tokens are consumed when a Generation is produced. Tokens may be acquired through a free allocation upon registration or purchased through the platform's payment processor.
5.3 Pricing. Prices are displayed in your local currency, inclusive of applicable taxes. We reserve the right to modify pricing; changes do not affect previously purchased tokens.
5.4 No Refund on Policy Violation. Tokens forfeited due to account termination for policy violations are non-refundable. For other refund requests, contact contact@narcis.ai.
By uploading any content to the Service, you represent and warrant that:

8.1 We run background checks to detect non-compliant content. Content that violates our policies may be removed, and the associated account may be suspended or terminated.
8.2 We reserve the right to review, remove, or restrict access to any content at our discretion, and to cooperate with law enforcement where required.
9.1 User Content. You retain ownership of the Face Photos and Target Images you upload. By uploading, you grant Narcis.ai a limited, non-exclusive license to process these images solely for the purpose of generating the requested content.
9.2 Generated Content. Subject to compliance with these Terms and applicable law, you retain ownership of AI-Generated Content produced from your inputs, for personal use. Commercial use requires separate authorization -- contact contact@narcis.ai.
9.3 Platform IP. All rights in the Service, its design, models, code, and branding remain the exclusive property of Narcis.
10.1 Processing. Uploaded images are processed on servers in the European Union (Frankfurt, Germany). Face Photos and Target Images are used solely to produce the requested Generation.
10.2 Storage. Generated images are stored on encrypted servers. Uploaded Face Photos are retained only for the duration necessary to complete the generation process.
10.3 GDPR. Processing of personal data (including biometric data derived from Face Photos) is governed by our Privacy Policy and subject to the General Data Protection Regulation (EU) 2016/679. The legal basis for processing biometric data is your explicit consent (Article 9(2)(a) GDPR), provided at the time of upload.
10.4 Right of Opposition. Any person whose likeness has been used without their consent may exercise their right to erasure under Article 17 GDPR by contacting contact@narcis.ai. See our Content Removal Policy.
11.1 The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
11.2 To the maximum extent permitted by applicable law -- and subject to mandatory provisions of French consumer law (Code de la consommation) -- Narcis shall not be liable for: any indirect, incidental, special, consequential, or punitive damages; any loss arising from User-Generated Content, including its misuse; any harm caused by a third party's use of the Service to generate content depicting your likeness; or service interruptions, delays, or errors.
11.3 Aggregate liability. Our total aggregate liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Narcis, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms or the Acceptable Use Policy; your violation of any third-party rights; any AI-Generated Content produced from your inputs; or your violation of any applicable law.
Narcis cooperates fully with French and EU law enforcement in accordance with applicable law. We respond to valid legal process (requisitions judiciaires, ordonnances, European Investigation Orders) within required timeframes. Where legally required or permitted, we report illegal content -- including CSAM -- to PHAROS, NCMEC if applicable, and Europol/EC3 as appropriate. Upon receipt of a valid preservation request, relevant data is preserved for a minimum of 90 days.
14.1 By User. You may terminate your account at any time. Unused tokens are non-refundable upon voluntary termination.
14.2 By Us. We may suspend or terminate your account at any time, with or without notice, for breach of these Terms or the Acceptable Use Policy. In cases involving illegal content, termination is immediate.
14.3 Effect. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature survive termination (liability, indemnification, data retention, intellectual property) shall survive.
These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France, subject to mandatory consumer protection provisions that may grant jurisdiction to the courts of your domicile.
For Users within the European Union, you may also submit disputes to the EU Online Dispute Resolution platform.
We reserve the right to modify these Terms at any time. Material changes will be communicated via your account email or by notice on the Service at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

This Acceptable Use Policy ("Policy") governs your use of Narcis.ai's AI portrait generation and face swap services. It is incorporated into and forms part of the Terms of Service. Violation may result in immediate account termination and reporting to authorities.
This Policy exists to prevent harm. Narcis.ai's face swap capability creates a specific risk of misuse: the ability to place any person's face onto any image. We take this seriously. This Policy defines what is and is not acceptable, and what happens when the line is crossed.
You may NOT upload, generate, or cause to be generated any content that includes, depicts, or facilitates:
Any sexual, nude, or suggestive content involving or appearing to involve minors. This is absolute. It includes AI-generated, cartoon, stylized, or simulated depictions. There is no exception, no edge case, no ambiguity.
Zero tolerance. Immediate report to authorities.
Any intimate, sexual, or nude imagery of an identifiable person created or shared without their explicit consent. This includes:
This is the core prohibition for face swap abuse. The fact that the image is AI-generated does not reduce the harm or the legal exposure. Under French law (Article 226-8-1 du Code penal, loi du 19 fevrier 2024), creating a deepfake of a sexual nature without consent is a criminal offense punishable by up to 2 years imprisonment and EUR 60,000 fine (3 years and EUR 75,000 when distributed online).
Content using the face or likeness of any identifiable individual without their authorization. When uploading a Face Photo that is not your own, you must have the depicted person's explicit, informed consent. This applies to public figures, private individuals, and deceased persons (where applicable law protects their likeness).
Content created to harass, bully, intimidate, threaten, or defame any person -- including placing a person's face in humiliating or degrading contexts, creating images to damage someone's reputation, or targeted campaigns using generated images.
Content depicting realistic violence, mutilation, or graphic injury. Content promoting hatred or discrimination based on any protected characteristic. Content facilitating fraud, impersonation, terrorism, or any activity prohibited by applicable law. Content infringing on the intellectual property rights of others.
By using Narcis.ai, you represent and warrant that:
CSAM: Account suspended immediately. Data preserved. Report filed with PHAROS and NCMEC.
NCII: Content removed. Account suspended pending review. Report filed where legally required.
Unauthorized likeness use with harassing or sexual intent. Violent or hateful content. Same-day action.
First offense: warning and content removal. Second: account suspension. Third: permanent termination, tokens forfeited.
In all cases: non-compliant content may be removed, we cooperate fully with law enforcement, and forfeited tokens are non-refundable.

Narcis.ai provides face swap technology. This capability can be misused to create non-consensual intimate imagery -- placing a person's face onto sexually explicit images without their knowledge or consent. We recognize this as one of the most serious forms of technology-facilitated abuse and have designed specific measures to prevent, detect, and address it.
Non-Consensual Intimate Imagery (NCII) includes any intimate, sexual, or nude image of an identifiable person that is created without their explicit consent (whether AI-generated, manipulated, or synthetic), OR distributed without their explicit consent, even if originally created with consent.
The harm is in the non-consent, not in the realism of the image.
NCII is illegal in France and across the European Union:
We employ automated and manual measures to detect and address non-compliant content. Content that violates our policies may be removed at any time, and we reserve the right to erase any generation and take action against associated accounts. Biometric data from face analysis is used solely for generation purposes and is not retained beyond the time required to complete your request.
